These Terms and Conditions ("Terms") govern your use of games published by TechTower Inc ("TechTower", "we", "us", or "our"), currently including KinPlay and Kinscapes. By installing, accessing, or using a game, you agree to these Terms. If you do not agree, do not use it.
1. Scope
Each game is a distinct product with its own listing, account space, progress, purchases, and features. Access, progress, or premium status in one game does not automatically transfer to another.
KinSparks is a quotes app that does not require an account and provides no virtual progress, purchase, or leaderboard features. The provisions of these Terms that concern accounts, virtual progress, purchases, and leaderboards apply only to KinPlay and Kinscapes.
2. Eligibility and accounts
- You must be legally able to agree to these Terms. A parent or guardian must supervise use where required by law.
- You are responsible for activity performed through your account and for keeping sign-in access secure.
- You must provide accurate information when creating or updating a registered account.
- Guest progress may be harder to recover. Connecting an account helps preserve progress across supported devices.
3. Limited license
We grant you a personal, limited, revocable, non-exclusive, non-transferable license to install and use the apps for lawful, non-commercial entertainment, subject to these Terms and the Google Play terms that apply to your download. We retain all rights not expressly granted.
4. Game progress and virtual items
Scores, XP, levels, streaks, coins, hints, rankings, and similar game elements are part of the service. They have no cash value, are not property, cannot be exchanged for money, and may not be sold or transferred outside functionality we expressly provide. We may correct progress affected by errors, abuse, or invalid activity and may adjust game balance to keep the experience fair.
5. Purchases, premium features, and refunds
- Paid products and premium entitlements are offered through Google Play and may differ between games.
- Pricing, billing period, included benefits, and renewal terms, when applicable, are shown before purchase.
- Google Play processes payments. Refunds and billing disputes are handled under Google Play rules and applicable law.
- Purchases are tied to the applicable store and app account and may require verification through Google Play and RevenueCat.
- Deleting an app account does not itself cancel an active Google Play subscription; manage subscriptions through Google Play.
6. Advertising and third-party services
Free app experiences may display advertising. The apps also depend on third-party services for sign-in, notifications, diagnostics, purchases, hosting, and distribution. Those services may have their own terms and privacy policies. Our Privacy Policy explains the main providers and data practices.
7. Acceptable use
You must not:
- Cheat, automate play, falsify results, manipulate leaderboards, or exploit bugs.
- Reverse engineer, redistribute, resell, copy, or modify an app except where applicable law expressly permits it.
- Interfere with service operation, probe security, bypass access controls, or overload our systems.
- Use another person's account without permission or impersonate another person.
- Submit unlawful, abusive, deceptive, infringing, or harmful content or profile information.
- Use the apps or services for unlawful or unauthorized commercial purposes.
8. Fair play and moderation
We may investigate suspicious activity, remove invalid scores, suspend leaderboard visibility, restrict an account, or terminate access when reasonably necessary to protect players, fair competition, or service integrity. We may use automated checks and human review.
9. Intellectual property
The apps, names, artwork, interfaces, software, game designs, text, sounds, and other content supplied by us are owned by or licensed to TechTower and are protected by intellectual-property laws. Third-party names and assets remain the property of their respective owners.
10. Updates and availability
We may add, change, rebalance, suspend, or discontinue features and may require an app update for security or compatibility. We aim for reliable service but do not promise that every feature will always be available, uninterrupted, or error-free. Internet access and a compatible device may be required for some features.
11. Disclaimers
To the fullest extent permitted by law, the apps and services are provided "as is" and "as available" without warranties of uninterrupted operation, fitness for a particular purpose, or freedom from every defect. Nothing in these Terms excludes a warranty or consumer right that cannot lawfully be excluded.
12. Limitation of liability
To the fullest extent permitted by law, TechTower is not liable for indirect, incidental, special, consequential, or punitive loss arising from use of the apps, loss of access, lost virtual progress, or a third-party service. Any limitation applies only to the extent allowed by applicable law and does not limit liability that cannot legally be limited.
13. Account deletion and termination
You may stop using an app at any time and may delete the relevant account through the app or our account-deletion page. A deletion request applies only to the selected game. We may suspend or terminate access for serious or repeated violations of these Terms, fraud, security risk, or legal necessity.
14. Changes to these Terms
We may update these Terms to reflect new features, providers, legal requirements, or business changes. The effective date identifies the current version. Continued use after revised Terms take effect means you accept them where permitted by law.
15. General
If a provision is unenforceable, the remaining provisions continue to apply. A failure to enforce a provision is not a waiver. These Terms, together with the Privacy Policy and purchase terms shown at checkout, form the agreement governing your use of the apps. Applicable mandatory consumer law remains unaffected.
